These Terms of Service govern your use of melroseavenuelabel.com and any purchase you make from it. The website is operated by Noire Eagle LLC, a Wyoming limited liability company. By using the site or placing an order, you agree to these terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm that you meet this requirement and that the payment method you use is your own or that you are authorized to use it.

2. Products and descriptions

We work to display our products, colors, and dimensions as accurately as possible. Screen settings vary, so actual colors may differ slightly from what you see. Product availability is not guaranteed and we may discontinue any item at any time.

3. Pricing and errors

All prices are in U.S. dollars. Applicable sales tax is calculated at checkout based on your shipping address. We reserve the right to correct pricing or description errors, and to cancel any order placed at an incorrect price, even after the order is confirmed. If we cancel an order for this reason we will refund you in full.

4. Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not constitute acceptance. Acceptance occurs when we ship the item. We may refuse or cancel any order, including where we suspect fraud, resale, or a breach of these terms.

5. Payment

Payment is taken at checkout. By providing payment details you confirm you are authorized to use them. If your payment is declined or reversed, we may cancel the order and pursue any amounts owed.

6. Shipping and returns

7. Intellectual property

All content on this website, including text, images, logos, designs, and the Melrose Avenue Label name and branding, is owned by or licensed to Noire Eagle LLC and is protected by U.S. and international intellectual property law. You may not copy, reproduce, or use it commercially without our written permission.

8. Acceptable use

You agree not to use the website for any unlawful purpose, to attempt to gain unauthorized access to our systems, to interfere with the site's operation, to scrape or harvest data, to submit false or misleading information, or to upload malicious code. We may terminate your access for any breach of this section.

9. User submissions

If you send us reviews, photographs, or other content, you grant us a non exclusive, royalty free, worldwide license to use, reproduce, and display that content in connection with our business, including in marketing. You confirm you own the content and that it does not infringe anyone else's rights.

10. Third party links

Our website may link to third party sites. We do not control them and are not responsible for their content, products, or privacy practices.

11. Disclaimer of warranties

The website and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non infringement. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

You agree to indemnify and hold harmless Noire Eagle LLC from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these terms or your misuse of the website.

14. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules.

15. Binding arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

Any dispute arising out of or relating to these terms, the website, or any product purchased from us will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Cheyenne, Wyoming, or by telephone or video at your election, and judgment on the award may be entered in any court with jurisdiction.

Class action waiver. You and Noire Eagle LLC agree that claims may only be brought in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Small claims exception. Either party may bring an individual claim in small claims court if it qualifies.

Your right to opt out. You may opt out of this arbitration agreement by emailing support@melroseavenuelabel.com with the subject line "Arbitration Opt Out" within 30 days of your first purchase, stating your name and order number. Opting out will not affect any other part of these terms.

If the class action waiver is found unenforceable, the entire arbitration section will be void.

16. Severability

If any provision of these terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
